Terms & Conditions
1. Documentation: Your Skyworth EV K Motor Vehicle Pre-Order Agreement (the “Agreement”) for the New Zealand market includes the following documents:
a. Vehicle Configuration: The configuration of your Skyworth EV K will be confirmed at a later date. This will describe the vehicle you select, including its features and pricing, excluding taxes, and any official or governmental fees specific to New Zealand.
b. Final Price Sheet: As your delivery date nears, a Final Price Sheet will be provided. This will include the final pricing based on your Vehicle Configuration and will incorporate applicable taxes and official fees relevant to New Zealand.
2. Agreement to Purchase: By making your Pre-Order Payment, you agree to pre-order the Skyworth EV K as per the configuration you select. The completion of this transaction and delivery of the vehicle will be conducted by Skyworth New Zealand or its affiliate. Your vehicle’s price and configuration will be based on options and features available at the time of order. Post-order options or features may not be included in your vehicle.
3. Pre-Order Price, Taxes, and Fees: The pre-order price will be confirmed in your Vehicle Configuration and Final Price Sheet. The price listed in the Vehicle Configuration will not include New Zealand specific taxes and fees, which will be calculated closer to the delivery time. You are responsible for these additional costs.
4. Pre-Order Process; Cancellation; Changes: After you submit your pre-order and once your selected options become available, we will invite you to finalize your vehicle configuration. The Pre-Order Payment is utilized to cover administrative costs, reservation services, and initial processing and is therefore non-refundable. It is not considered a deposit for the vehicle. While you may cancel your pre-order at any time before delivery, please note that the Pre-Order Payment will not be refunded due to the immediate administrative and processing costs incurred by your reservation. Changes to your Vehicle Configuration are permissible but may result in price adjustments based on current pricing. The Pre-Order Payment will be applied to the final price of your vehicle, acknowledging its role in covering initial administrative and reservation expenses.
5. Delivery: Details regarding the delivery process, including pickup locations or shipping arrangements within New Zealand, will be communicated as your delivery date approaches. Failure to take delivery within the specified timeframe may result in your vehicle being made available to other customers or cancellation of your pre-order.
6. Acknowledgement of Development Stage: At the time of entering this Agreement, Skyworth may still be in the process of developing the EV K model, and manufacturing schedules can vary. Therefore, we cannot guarantee a specific delivery date, which will depend on your vehicle’s configuration and production schedules.
7. Security Interest: To secure your final payment and performance under this Agreement, Skyworth New Zealand will retain a security interest in the vehicle until all your obligations under this Agreement are fulfilled.
8. Privacy Policy; Payment Terms for Services; EV Charging Fair Use Policy: Skyworth’s Customer Privacy Policy, Payment Terms for Services, and EV Charging Fair Use Policy are integral parts of this Agreement. These can be accessed at SKYWORTH NZ Legal. It is important that you review these policies to understand our practices.
9. Incentives: Skyworth makes no representations or warranties regarding the availability or your eligibility for any incentives, rebates, or tax credits (“Incentives”) related to the EV K. If Skyworth has credited your Purchase Price for the amount of an Incentive, but you are later found ineligible for the Incentive, you shall reimburse Skyworth for the credited amount.
10. Limitation of Liability: Skyworth is not liable for any incidental, special, or consequential damages arising from this Agreement. Your exclusive remedy under this Agreement is limited to the reimbursement of your Pre-Order Payment.
11. No Resellers; Discontinuation; Cancellation: Skyworth EVs are sold directly to end-consumers, and we strictly prohibit resale. We reserve the right to unilaterally cancel any order we suspect is intended for resale or made in bad faith, and the Pre-Order Payment in such cases is non-refundable. This policy applies to orders facilitated by a third party or intended for export outside the declared registration region. Similarly, if we discontinue a product, feature, or option after your pre-order, or if we determine any bad faith actions on your part, we may cancel your pre-order. In such scenarios, the Pre-Order Payment will not be refunded, acknowledging its use in covering the costs associated with processing and managing your initial order.
12. Governing Law; Integration; Assignment: This Agreement is governed by and interpreted in accordance with the laws of New Zealand. All previous agreements, oral statements, negotiations, communications, or representations about the Skyworth EV K are superseded by this Agreement. Only terms expressly stated in this Agreement are binding. Skyworth reserves the right to assign this Agreement at our discretion to one of our affiliated entities.
13. Region Specific Provisions: You acknowledge having read and understood the provisions applicable to you in the Region-Specific Provisions attachment to this Agreement. This attachment includes additional terms and conditions relevant to the New Zealand market, ensuring compliance with local laws and regulations.
